How We Use Your Personal Information

We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy.
- Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This Privacy Notice (“Notice”) applies to the websites located at futurebean.com, and the Futurebean mobile applications available in the Apple App Store, the Google Play Store (“Futurebean App”), when you visit our stores, and through any other websites or applications owned and operated by Futurebean brands or products that direct the viewer or user to this Notice(“Futurebean Services”). Our websites and mobile applications may offer links to websites and/or other mobile applications that are operated by third parties and not by Futurebean. If you visit one of these linked websites, you should read the website’s privacy notice, terms and conditions, and their other policies. We are not responsible for the policies and practices of third parties. Any information you give to those organizations is governed under their privacy notice, terms and conditions, and other policies.

When you visit and use the Futurebean Services, we may collect the following categories of information:
- Identifiers – We may collect information that can be used to identify you, such as your first and last name, phone number, your address book, username and password, email address, postal address, IP address, day and month of your birthday, and demographic information (such as gender).
- Financial Information – We may collect information such as your credit card and debit card information, telephone number, and name.
- Commercial Information – We may collect information about your transactions in our stores, on our websites or via our Futurebean App including what products you purchase, and how frequently you purchase them.
- Electronic Network Activity Information – We may collect information related to your electronic network activity, such as your browsing history, information about how you use the Futurebean Services, and information about your device.
- Precise Geolocation Information – We collect information about the precise location of your device (e.g., GPS latitude and longitude), consistent with your device settings. We also use location-based technology in our retail locations, to collect information about the presence of your device, if your Bluetooth is turned on and your device settings allow for this. We collect this location information or derive it from your GPS, WiFi, Bluetooth or other location-based technology for purposes of facilitating our services, such as to provide you with information about stores near you, to enable you to remotely order and pay for our products and so that you may have certain Futurebean products delivered to you.
- Audio and Visual Information – We may collect audio and visual information when you use the Futurebean Services. For example, closed circuit video surveillance cameras (“CCTV”) may be installed at some of our retail locations to monitor building security and assist in crime prevention, detection, and investigation, and to ensure the safety of our staff and visitors to our facilities, and these CCTV cameras may collect audio, visual, and similar information. Also, depending on your choices, we may collect audio information when you use voice ordering.
- Inferences – We may collect inferences drawn from the other information described above.
- Other – We may collect other information that you voluntarily provide when you communicate with us. We may aggregate or de-identify the information described above. Without this information, we may not be able to provide you with all the requested services.
4. How We Use Your Information
We may use your information for business purposes, including to provide the products and services you request, to perform customer service functions, for security and fraud prevention, for marketing and promotional purposes, and to perform website and mobile application analytics. We may use the information we collect about you to:

We and others may use a variety of technologies to collect information about your device and use of our websites and mobile applications. These technologies include first- and third-party cookies, web beacons, JavaScript, entity tags, HTML local

- User Convenience – Some of these technologies enhance the ease of use of our websites and mobile applications and the services and functionality they make available by accelerating load and refresh times and remembering

Futurebean uses reasonable technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of your information. However, no security system is perfect, and due to the
inherent nature of the Internet, we cannot guarantee that data, including personal information, is absolutely safe from intrusion or other unauthorized access by others. You are responsible for protecting your password(s) and maintaining the security of
your devices.
8. Retention
Futurebean stores information as reasonably necessary and proportionate to accomplish the purposes identified in this Notice based on criteria such as the time required to provide the services to you, and to meet legal requirements, including record retention, resolving disputes, and enforcing our agreements. Our retention of your information is governed by applicable law. The personal information that you provide us is stored and processed on servers owned by Futurebean and other companies in the United States, including locations outside of the jurisdiction where you are located. Regardless of the company or person who processes your information and where it is processed, we will take steps to transfer and protect your information
through appropriate safeguards in accordance with applicable data protection laws and this Notice.
9. Children’s Privacy
We do not intend for our websites or online services to be used by anyone under the age of 13. We do not knowingly collect, sell, or share information of consumers between the ages of 13 – 16. If you are a parent or guardian and believe we may have
unintentionally collected information about your child, please contact us immediately as described in the “Contact Us” section of this Notice.

Your Choices
Location Services – In order to use certain Futurebean Services, such as mobile order and pay (“MOP”) and location-based delivery services and technology, you must either (a) enable “location services” in the Futurebean App;
and/or (b) set the permissions in your mobile device to allow communication of this information. If you allow for location sharing, your device must communicate with us in ways that allow for us to customize your experience in and around Futurebean stores. Precise geolocation is used to fulfill any delivery services and application functionality you choose to engage with. You can manage the use of that personal information at any time in your device settings. For most mobile devices, you can disable the collection of geolocation information by turning off location services on your device. Disabling the collection of geolocation information will result in an inability to access delivery services and application functionality you would other wish to engage with. Certain Futurebean App features and some Futurebean Services may not work properly without information about your location. You can selectively re-enable or disable the collection of geolocation information, at any time, by turning on or off the location services on your device. Email Communications, Push Notifications, In-App and Text Messages – The Futurebean App allows all users to set preferences for receiving promotional email communications from Futurebean, receiving push notifications on your device, and receiving inbox and/or text messages. If you opt-out of receiving promotional emails from us, we may still
send communications to you about your orders and transactions, and any accounts you have with us.

Your Rights
Depending on where you live, you may be entitled to certain rights with respect to your personal information, as described below.
Right to Know – You may have the right to know what personal information the business has collected about you, including the categories of personal information, the categories of sources from which it is collected, the business or
commercial purposes for collecting, selling, or sharing it, and the categories of third parties to whom we disclose it. Access and Data Portability – Subject to certain exceptions, you may have the right to request a copy of the personal
information that we collected about you during the 12 months before your request.
Deletion – You may have the right to request that we delete information that we collected from you and retained, subject to certain exceptions.
Correct Inaccurate Information – You may have the right to request that we correct inaccuracies in the personal information we maintain about you. You may also correct information about you for Futurebean Rewards in the Futurebean App.
Targeted Advertising – We do not sell your information for monetary or valuable consideration. You may have the right to opt-out of having your personal information shared for purposes of targeted advertising.
Sensitive Information – Companies who collect, use, and disclose your sensitive personal information for purposes other than to provide you with goods or services are required to provide you with the right to limit the use and disclosure of your sensitive personal information by providing a “Limit the Use and Disclosure of My Sensitive Personal Information” link. Futurebean only collects, uses, and discloses your sensitive personal information to provide services to you, therefore Futurebean is not required to provide this link.
Opt-Out Preference Signals – Some web browsers allow customers to automatically exercise their right to opt-out of sale/sharing with all businesses they interact with online by initiating an opt-out preference signal. We will honor such opt-out preference signals.
Appeals – You may appeal our decision with respect to a request you have submitted by contacting us as described in
the “Contact Us” section below. U.S. residents may submit requests under this section by contacting Futurebean Customer Care at 9459 Coppertop Loop NE,
Bainbridge Island, WA 98110 (Phone: 206-401-7492). Once we receive your request, we may verify it by requesting information sufficient to confirm your identity. You may be entitled to submit a request through an authorized agent or to appeal a refusal to take action on your request. To designate an authorized agent to exercise your rights, we will require written proof that the authorized agent has been authorized to act on your behalf or a copy of the power-of-attorney document granting that right.

FUTUREBEAN iOS Privacy Policy
Please read the following provisions, as well as the complete Futurebean Privacy Policy (located at www.futurebean.com/privacy-policy), carefully to understand how Futurebean collects, uses and discloses personally identifiable information from its users, including with respect to the Futurebean mobile application (“Application”). By downloading, installing, accessing or using the Application, you consent to all actions that we take with respect to your data consistent with our Privacy Policy and the following provisions.
User Information
Some functionality of the Application, including using an iOS product (“Device”) to purchase Futurebean products, using the Application to order and pay for certain Futurebean products prior to arrival at the store (“MOP”), including by placing an order
using voice commands (“Voice Ordering”), location-based services and functionality, iBeacons or other location-based technology to enhance the user experience, and access of User’s address book may require the transmission of information provided by the User, including user names and passwords, addresses, e-mail addresses, phone number, financial information (such as credit card numbers), employer name, voice, or GPS location (“User Information”). In order to use certain Application functionality, such as MOP and location-based services and technology, User must either (a) enable “location services” in the Application; and/or (b) set the permissions in his or her mobile device to allow communication of this information. In addition, in order to use certain Application functionality such as Voice Ordering, User must (a) enable
“microphone” and “speech recognition” in the Application; and/or (b) set the permissions in his or her mobile device to allow communication of this information. If the User uses such Application functionality, the User consents to the transmission of
User Information to Futurebean and/or its agents, and authorizes Futurebean and/or its agents, to record, process, and store such User Information as necessary for the Application functionality and for purposes described in the Futurebean Privacy
Policy. Please see the Privacy Policy for more information about how we may use and store such User Information, and how to opt out of sharing User Information, including GPS location and voice. The User is solely responsible for maintenance of the confidentiality and security of any User Information which the User transmitted from or stored on a Device for purposes of the Application, whether authorized or unauthorized. The User agrees to immediately notify Futurebean of any unauthorized transactions associated with the Application including Mobile Payment, MOP, Voice Ordering, or any other breach of security. Futurebean shall not be responsible for any losses arising out of the loss or theft of User Information which the User transmitted from or stored on a Device or from unauthorized or fraudulent transactions associated with the Application.
Email Communications, Push Notifications, In-App Messages, Text Messages
If a User signs up for a Futurebean account using the Application, the User is, by default, opted in to receive promotional email communications from Futurebean (“Email Communications”). The User may, at the time of sign up, opt out of receiving Email
Communications from Futurebean. Thereafter, the User may opt out of receiving Email Communications solely by adjusting the User’s profile settings in the User’s Futurebean account via www.Futurebean.com. Similarly, upon download of this Application, the User is provided the option to opt into receive push notifications from
Futurebean on his or her Device. This may include promotional communications, offers, and system messages pushed to the Device or within the Application mailbox (“Push Notifications”). The User may, at any time following download of this Application, opt out of receiving Push Notifications by type by adjusting the “Futurebean Notifications” switch within the Application settings to “off", or within the Device’s settings application under "Notifications" to completely opt out of Push Notifications. Opting out of Push Notifications will not affect User settings with respect to Email Communications. Finally, by using this Application, in-app messages and/or text messages will automatically be displayed to the User via the Application’s display tiles and/or sent to the User via the Application’s Inbox, including promotional communications, offers, and communications related to delivery of Futurebean products and/or services. If the User does not wish to see or receive such messages, the User must cease use of the Application.
